Public offer contract
on the formalization of reservation services, issuance and sale of tickets for bus transportation of passengers and luggage
This agreement is an official and public proposal of SVD Trans s.r.o. (Seller) conclude a contract of sale of the Product (receipt) presented on the website svdtrans.com and at the SVD Trans cash desk. This agreement is made publicly, and is the same for all buyers regardless of their status (individual, sole practitioner, individual entrepreneur) without giving preference to one purchase over another.
By entering into this Agreement, the Buyer is fully obligated to accept the procedure for formalizing the agreement, paying the receipt and its return, reporting for dishonest order and all other agreements. The contract is considered concluded from the moment of clicking the "Buy" button on the order page and the Buyer receiving the order confirmation from the Seller in electronic form to the e-mail address specified by the Buyer, or from the moment of paying for the ticket at the SVD Trans company cash desk.
1.Definition of terms
1.1. Public offer (hereinafter - the "Offer") - a public offer of the Seller, addressed to an unspecified circle of people, to enter into a contract for the purchase and sale of goods with the Seller (hereinafter - the "Agreement") on the terms contained in this Offer.
1.2. Product or Service – a ticket that was selected and purchased by the buyer on the Seller's website or at the SVD Trans company ticket office. Ticket payment is possible in Czech currency, in Ukrainian currency and in euros.
1.3. The Seller's website - the website at the address www.svdtrans.com is created for the conclusion of retail and wholesale sales contracts based on the Buyer's familiarization with the description of the Products proposed by the Seller using the Internet.
1.4. Buyer (Passenger) – an individual who receives information from the Seller, places an order for the purchase of goods presented on the Site for purposes not related to the implementation of business activities or a sole practitioner, individual entrepreneur.
1.5. Seller (Carrier) – Limited Liability Company SVD Trans s.r.o. (IČO: 261 94 287, DIČ: CZ26194287), whose location is Křižíkova 345/4, 186 00 Praha 8 - Karlín, Česká Republika, its permanent representative office in Ukraine PREDSTAVNYSTVO SVD TRANS S.R.O., (EDRPOU: 2657949), address, Lviv region, 82 100 Drohobych city, square Zluki 7 and sole practitioner the cooperation have signed agreements.
2.Subject of the Agreement
2.1. The conclusion of the Offer creates binding legal relations between the Carrier and the Passenger on the basis of transport rules, tariffs and announced contractual conditions of carriage; in particular, they contain the Carrier's obligation to transport the Passenger from the departure station to the destination station in a proper manner and the Passenger's obligation to comply with the transport regulations and contractual terms of the Offer and to pay the price for the transport (hereinafter - "Tariffs").
2.2. The date of conclusion of the Contract-offer (acceptance of the offer) and the moment of full and unquestionable acceptance by the Buyer of the terms of the Contract shall be considered the date when the Buyer fills out the order form located on the Site, provided that the Buyer receives an order confirmation from the Seller in electronic form (electronic ticket) or purchases a ticket at the company ticket office SVD Trans.
3.Placing the order
3.1. The buyer places an order independently on the Site, or by placing an order by e-mail or at the phone number specified in the contact section of the Site, or by purchasing a ticket at the SVD Trans company ticket office, as well as at the ticket offices and websites of SVD Trans official partners.
3.2. The Seller has the right to refuse to transfer the order to the Buyer if the information provided by the Buyer during the order placement is incomplete or raises suspicions about their validity.
The ticket is invalid if:
a) the passenger has not fulfilled the conditions for its use set out in the Offer, tariffs or conditions of the transportation contract;
b) the proposed data is not filled in;
c) the ticket is damaged in such a way that it does not show the data necessary to check the correctness;
d) the data are untrue or unreasonably changed;
e) were issued under the surname and first name, and are used by another person;
g) its validity period has expired.
3.3. When placing an order, the Buyer confirms himself with a valid travel document and undertakes to provide the following mandatory information necessary for the Seller to fulfill the order:
a) first name, surname of the Passenger;
b) e-mail address of the Passenger;
c) contact phone number.
3.4. A ticket for an individual trip includes:
a) company name of the carrier that concludes the transportation contract;
b) surname, first name of the Passenger;
c) station and time of departure and arrival;
d) the amount of the tariff, the type of travel and/or the amount of the discount;
e) information about the validity period of the ticket;
g) other information that allows you to check the validity and correctness of its use, as provided by the contractual conditions of transportation.
3.5. The name, quantity, article number, and price of the Ticket selected by the Buyer are specified by the Seller on the Site.
a) It is possible to purchase a one-way or two-way ticket for SVD Trans company routes on a set date or an open date;
b) a ticket for an open date is valid on the Seller's routes for 6 months from the date of purchase of the ticket. When reserving a return trip, a place for the Buyer will be provided according to the available capacity of the bus. Passengers are advised to make reservations at least 7 calendar days before the expected date in person at the SVD Trans office, or by phone:

3.6. If any of the parties to the contract needs additional information, it has the right to request it from the other party. If the Buyer does not provide the necessary information, the Seller is not responsible for the quality of the Buyer's service when purchasing the goods.
3.7. When placing an order through the Seller's operator (clause 3.1. of this Offer), the Buyer undertakes to provide the information specified in clauses 3.3 - 3.4. of this Offer.
3.8. The Buyer's acceptance of the terms of this Offer is carried out by entering the relevant data into the registration form on the Site or when placing an order by e-mail or by phone, or at the SVD Trans company cash desk. After placing an order by e-mail or by phone, or at the SVD Trans company cash desk, the Buyer's data is entered into the Seller's database.
3.9. The buyer is responsible for the accuracy of the information provided when placing the order.
a) The ticket for individual travel can only be used by the person on whose name it was issued and is invalid if the passenger does not confirm himself with an official document.
3.10. By concluding the Agreement, i.e. accepting the terms of this offer (the proposed terms of purchase of the Goods), by placing an order, the Buyer confirms the following:
a) The buyer is fully and completely acquainted with and agrees with the terms of this offer (Offer);
b) he gives permission for the collection, processing and transfer of personal data, the permission for processing personal data is valid for the entire term of the Agreement, as well as for an unlimited period after its expiration. In addition, by concluding the contract, the Buyer confirms that he is informed (without additional notification) of the rights established by Regulation (EU) 2016/679 of the European Parliament and of the Council "On the protection of personal data", about the purposes of data collection, as well as that his personal data are transferred to the Seller for the purpose of fulfilling the terms of this Agreement, the possibility of mutual settlements, as well as for receiving invoices, acts and other documents. The Buyer also agrees that the Seller has the right to provide access and transfer his personal data to third parties without any additional notifications from the Buyer for the purpose of fulfilling the Buyer's order. The extent of the Buyer's rights as a subject of personal data in accordance with the Regulation "On the Protection of Personal Data" is known and understood by him.
4. Product price
4.1. Prices for tickets and services are determined by the Seller independently and indicated on the Site.
4.2. Prices for tickets and services may be changed by the Seller unilaterally depending on market conditions. At the same time, the price of the ticket and services, the cost of which has been paid in full by the Buyer, cannot be changed unilaterally by the Seller.
4.3. The passenger pays the fare before boarding the vehicle.
4.4. The Buyer's obligations to pay for the Goods are considered fulfilled
a) when buying a ticket on the Site from the moment the funds are received by the Seller on his account;
b) when buying a ticket at the SVD Trans company ticket office from the moment the ticket is paid to the Seller.
4.5. When receiving the ticket, the Buyer must check the conformity of the Product according to qualitative and quantitative characteristics (clause 3.4 of this Offer).
4.6. Passengers pay for travel according to the tariff of an individual travel ticket. In the Czech Republic, tariffs are set and paid in Czech crowns. In Ukraine, the fare is set and paid in Ukrainian hryvnias. On the territory of foreign countries, the fare is set in international currency (euro, dollars).
5. Discounts
5.1. The seller provides the following discounts:
a) children from 0 to 12 years inclusive, traveling with their parents or another accompanying adult: 50% discount from the basic tariff;
b) persons over 60 years of age: a 10% discount from the basic tariff;
c) a 20% discount on a return ticket, provided that the Buyer simultaneously purchases round-trip tickets or purchases a return ticket during the trip. This discount is valid only for connections operated by SVD Trans buses. Discounts are not cumulative, that is, the Buyer can use only one of the listed discounts.
5.3. A passenger claiming a discount must prove the right to a discount when buying a ticket and before boarding the bus. In the case of that the right to a discount when boarding the bus is not proven, the passenger is obliged to pay the price difference and a processing fee of 100 Czech crowns, or the equivalent in the relevant currency.
5.4. Exceptions to these rules may occur for limited-time promotional offers. More detailed information can be found in the separate conditions of promotions, which are posted on the Site.
6. Rights and obligations of the Parties
6.1. The seller is obliged to:
a) deliver the goods to the Buyer in accordance with the terms of this Agreement and the Buyer's order;
b) not to disclose any private information about the Buyer and not to provide access to this information to third parties, except for cases provided by law and during the execution of the Buyer's order.
c) each passenger is insured during transportation.
6.2. The seller has the right to:
a) unilaterally change the terms of this Agreement, as well as the prices of tickets and services, by posting them on the Site. All changes take effect from the moment of their public
b) to cancel or change the transportation schedule by informing about this fact by telephone or electronic means of communication of passengers who have informed the carrier of the telephone number or data necessary for electronic communication. In these cases, passengers have the right to a full refund of the paid fare;
c) change the route without changing its starting and ending stations;
d) change the vehicle and crew members in case of technical or organizational need;
e) change seats for passengers;
f) not to provide services to specific passengers without a specified reason;
g) video and audio recording of the process of providing services at SVD Trans branded cash registers, the process of placing an order by phone number and the process of transportation for the purpose of monitoring the quality of services.
6.3. Buyer (Passenger):
a) undertakes to familiarize himself with the content of the Agreement, the terms of the Agreement and the prices offered by the Seller on the Site or at the SVD Trans cash register before the conclusion of the Agreement;
b) the Seller undertakes to fulfill his obligations to the Buyer, the latter must provide all the necessary data that uniquely identify him as the Buyer;
c) is deprived of the right to transport if he is under the influence of alcohol, narcotic or other psychotropic substances. In these cases, the Carrier is immediately released from all contractual obligations to the Passenger and is not obliged to pay him, even partially, the fare or other compensation;
e) is not entitled to compensation in case of voluntary termination of the trip.
7. Liability
7.1. The passenger should take into account the possibility of delays when planning his further route. The carrier is not responsible for damages caused by the work of customs and border services, weather conditions, traffic jams and other circumstances that caused traffic delays and led to a violation of the bus schedule.
7.2. The Seller is not responsible for improper, untimely fulfillment of Orders and its obligations in the case that the Buyer provides inaccurate or erroneous information.
7.3. The Carrier and the Passenger are responsible for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.
7.4. The Seller or the Buyer is released from responsibility for full or partial non-fulfillment of their obligations, if the non-fulfillment is the result of force majeure circumstances such as: war or hostilities, earthquake, flood, fire and other natural disasters that occurred regardless of the will of the Seller and/or The buyer after concluding this contract. A Party that cannot fulfill its obligations shall immediately notify the other Party thereof.
7.5. The passenger is personally responsible for compliance with the passport and customs regulations of the countries to which he is traveling or through which he is passing. All costs associated with non-compliance with these regulations shall be borne by the Passenger. If the Passenger is not allowed by the customs or police authorities to continue the journey, he is not entitled to a refund of the fare, even a part thereof, or any other compensation.
7.6. The passenger is financially responsible for damage to the Carrier's property.
7.7. The presence of a passenger's ticket does not guarantee him the opportunity to travel on an international bus route if the documents he has (visa, type of passport, other documents necessary for entry or transit through other countries) do not meet the requirements of customs and border services. In this case, the ticket price is not refundable.
7.8. Additional services, such as distribution of hot and cold drinks, newspapers and magazines, movie screenings, Internet connection via Wi-Fi, are provided based on the operational capabilities of the transport, and their failure to provide does not give the passenger any compensation.
8. Return and change of tickets
8.1. The buyer has the right to refuse the trip, return the Ticket and get back the full or partial value of the Ticket, depending on the deadline for its return:
a) return after 15 minutes after purchase - returned without withholding of funds;
b) return more than 48 hours before departure - 85% of the Ticket price is returned;
c) return less than 48 hours, but more than 24 hours before departure - 70% of the Ticket price is returned;
d) return less than 24 hours, but more than 12 hours before departure - 50% of the Ticket price is returned;
e) return less than 12 hours before departure - 0% of the Ticket value is returned, i.e. there is no return.
8.2. The cost of the appropriate ticket shall be returned to the Buyer within 30 (thirty) calendar days from the date of receipt of the application for the return of the ticket by the Buyer, subject to compliance with the requirements stipulated in Clause 8.1. Agreement.
8.3. The cost of the product is subject to refund by bank transfer to the Buyer's account.
8.4. Tickets are returned, in the cases provided for by law and this Agreement, to the email address specified on the Site in the "Contacts" section
8.5. Under certain conditions, the passenger may request to change the trip to another date. This change can be made by the Carrier only twice. The first change is free, the second - for a fee of 200 Czech crowns, or the equivalent in the relevant currency. Change is possible only within the terms / combinations that are available in the sales system.
8.6. It is possible to change the date or time of the ticket 48 hours before departure. A ticket that has been changed within 48 hours before departure can no longer be changed. It is impossible to cancel such a ticket. It is not possible to change the departure date or time in less than 12 hours.
8.7. An open-date ticket can be changed after booking for a specific date under the same conditions as a fixed-date ticket.
8.8. Changing the station of departure and arrival on the route is free of charge, only any difference in price is charged. Overpayment is non-refundable.
8.9. It is not possible to change a ticket purchased in a special price offer if it is a condition of the discount.
8.10. The passenger has the right to compensation if the departure on the route does not take place due to the reasons of the Carrier.
9. Confidentiality and protection of personal data
9.1. By providing his personal data on the Site when registering or placing an order, the Buyer gives the Seller his voluntary consent to the processing, use (including the transfer) of his personal data, as well as taking other actions provided for by Regulation (EU) 2016/679 of the European Parliament and of the Council "On the protection of personal data, without limitation of the term of validity of such consent.
9.2. The Seller undertakes not to disclose the information received from the Buyer. It is not considered a violation for the Seller to provide information to counterparties and third parties acting on the basis of a contract with the Seller, including for the fulfillment of obligations to the Buyer, as well as in cases where the disclosure of such information is established by the requirements of current legislation.
9.3. The buyer is responsible for keeping his personal data up to date. The Seller is not responsible for poor performance or failure to fulfill its obligations due to the irrelevance of information about the Buyer or its inconsistency.
10. Other conditions
10.1. Transportation of people
a) Passengers are advised to arrive at the departure point at the main boarding stops no later than 30 minutes before the departure of the bus. If the passenger does not show up for boarding, he loses the right to travel;
b) each passenger is entitled to only 1 seat. If a passenger has purchased two or more seats, the passenger is entitled to the corresponding number of seats purchased. The passenger must be fastened during the entire trip, if his seat is equipped with a seat belt;
c) children under the age of 16 do not have the right to travel unaccompanied by their parents or another adult. Children under the age of 12 should not travel on seats in the first and second rows, i.e. seats 1-8. When buying a ticket, the passenger must inform that this seat is for a passenger up to 12 years old inclusive;
d) in of a technical stop during the trip, the passenger must return by the end of the time determined by the driver or flight attendant. If the passenger did not return to the vehicle after the stop, it means that he voluntarily refused to continue the trip. In this case, the passenger has no right to compensation or other compensation;
10.2 Animals are not transported on SVD Trans flights.
10.3 Baggage transportation
a) one piece of hand luggage with maximum dimensions of 20x30x40 cm and a weight of 5 kg and one main luggage with a maximum size of 40x60x80 and a weight of 25 kg per passenger is transported free of charge;
b) additional baggage is paid at a rate of 200 Czech crowns or more, or the equivalent in the relevant currency for each additional piece of baggage. The presence of additional luggage must be agreed with company representatives in advance;
c) the carrier reserves the right not to accept additional baggage if it has not been notified, or if there is no room for it in the baggage compartment;
d) there should be no objects in the luggage or the contents of the luggage, which by their properties can cause damage to the vehicle, as well as damage to the life and health of other passengers;
e) if the carriage of luggage is subject to payment of import duty or CLA or other duty, the passenger is obliged to pay the corresponding amount before loading the luggage b) additional baggage is paid at a rate of 200 Czech crowns or more, or the equivalent in the relevant currency for each additional piece of baggage. The presence of additional luggage must be agreed with company representatives in advance;
c) the carrier reserves the right not to accept additional baggage if it has not been notified, or if there is no room for it in the baggage compartment;
d) there should be no objects in the luggage or the contents of the luggage, which by their properties can cause damage to the vehicle, as well as damage to the life and health of other passengers;
e) if the carriage of luggage is subject to payment of import duty or CLA or other duty, the passenger is obliged to pay the corresponding amount before loading the luggage into the bus.
10.4. Complaints, loss and damage of baggage
a) each complaint must be submitted no later than 30 days after the end of the trip and must be accompanied by a ticket. Complaints can be submitted at the place where the ticket was purchased, sent by mail or e-mail to the address of the Carrier. The complaint will be resolved within 30 days of receipt;
b) complaints about the loss, theft or damage of luggage must be submitted by passengers immediately after receiving the luggage at the destination stop from the carrier's employee. If the Passenger did not state otherwise to the Carrier's employee when boarding the bus, the declared value of the baggage is 200 Czech crowns, or the equivalent in the relevant currency;
c) if the registered baggage is lost or if the passenger had an obvious violation or incompleteness of the baggage or circumstances indicating this during the handover of the baggage, the carrier immediately asks the passenger to establish the condition of the checked baggage and draw up a report. This record, together with the ticket and baggage ticket, is a necessary part of the complaint, which must be made in writing;
c) if the registered baggage is lost or if the passenger is found to have an obvious violation or incompleteness of the baggage or circumstances indicating this during the handover of the baggage, the carrier immediately asks the passenger to establish the condition of the checked baggage and draw up a report. This record, together with the ticket and baggage ticket, is a necessary part of the complaint, which must be made in writing;
d) if the passenger accepts the baggage without a reservation, it is considered that he accepted the baggage in full and good condition.
11. Final provisions
11.1 All disputes arising between the Buyer and the Seller shall be resolved through oral and written negotiations. In case of failure to reach a settlement of the disputed issue through negotiations, the Buyer and/or the Seller have the right to apply for a resolution of the dispute to the judicial authorities in accordance with the current legislation.
11.2. The seller has the right to make changes to this Agreement unilaterally.
